Finsket's general terms and conditions

 

1. Introduction

 
These general terms and conditions apply to the sale of products in PaaPii Design Oy's (hereinafter "Finsket") online store. The terms and conditions can also be applied to other sales than through the online store, if Finsket refers to the application of these terms.

Finsket's customers can be consumers, companies, other legal entities and entrepreneurs.

Finsket has the right to amend these terms. The amended terms and conditions will be published on this page. Orders are subject to the terms valid at the time of placing the order. Finsket also has the right to update the prices of its products and the delivery costs it has announced. The main features of the products are shown on the product pages on the online store.

3. Applicability of these terms and placing orders


 These terms apply when the customer buys products from Finsket's online store. By placing an order, the customer accepts that these terms and conditions apply exclusively to the order. As a general rule, a person ordering products from our online store must be at least 18 years old. A person under 18 but at least 15 years old can order products only with the permission of the guardian and pay for their purchases only with online payment.

The customer can buy products from our online store either after registering as a customer or without registration. However, when registering and/or ordering, the customer must provide the information necessary to process the order.

Before making the payment, the customer must accept these terms. After this, by pressing the "Order" button on the order form, a binding order is made and concluded, and a contract is formed between Finsket and the customer. The order confirmation is sent to the customer's email address, where the order information can be checked. As a registered customer, you can easily monitor order processing and your orders through your own account. Finsket has the right to cancel or not accept the order for a justified reason (e.g. the ordered product is not available, incomplete contact information, it is not possible to deliver the product to the customer's address, an obvious pricing error has occurred in the pricing of the product). If the customer has paid for the order before Finsket cancels the order, the payment will be returned to the customer.

As a wholesale or retail customer, you can basically only buy from Finsket if you have been approved by Finsket as a wholesale or retail customer and a wholesale or retail customer's user account has been created for the online store.


4. Prices, payment methods and payment terms


 The consumer prices of the products are indicated in the online store as total prices including VAT. In addition to the price, the customer will have to pay delivery costs (if any), which will be indicated when placing the order, and paid when paying for the products. In special cases, Finsket has the right to correct the price of the product after the order, if there has been an obvious mistake in the pricing or the price is exceptionally low compared to the general price level.

Accepted payment methods include online bank payment, card payments (Visa, Visa Electron, MasterCard), mobile payment methods (Siirto, MobilePay, Pivo), Paypal, and invoice and installment payment. More detailed information about the available and accepted payment methods at any given time appears when starting the order process. Credit-based payment methods may also require the acceptance of other contract terms and the provision of a personal identification number in order to check creditworthiness. Finsket uses third party payment services providers, such as Avarda, in its online store.

Prices for wholesale or retail customers are displayed in the online store when the user is logged in to the online store with a wholesale or retail user account. Wholesale or retail customers may also have other payment methods accepted or offered by Finsket than those mentioned above, such as advance payment or company invoice. Unless otherwise stated by Finsket, the wholesale or retail customer's invoice must be paid within 30 days from the date of the invoice. Advance payment is generally the payment term for (1) the first delivery of a wholesale or retail customer, (2) orders from foreign wholesale or retail customers and (3) fabric wholesale orders. In the event of a delay in payment by the wholesale or retail customer, Finsket has the right, in addition to its other legal remedies, to refrain from delivering the ordered products until the due amount has been paid in full. Late payment interest is in accordance with the Interest Act.


5.  Delivery methods, terms and costs


In addition to the price of the product, the customer will have to pay delivery costs if the product has to be sent to the customer. Delivery costs usually start from €4.90 when sending the ordered product to an address in Finland. Delivery costs can be found in the shopping cart of the online store. You can find the delivery costs and delivery methods for other countries in the shopping cart of the online store when you select the delivery country. We deliver products to Finland and those countries that can be selected as the delivery country in the online store's shopping cart at any given time. Alternative delivery methods and their respective delivery costs are presented on the order form.

In the delivery of the products, the aim is to process orders as quickly as possible. As a rule, the products are usually sent within five business days of receiving the order. Any exceptions to delivery times will be notified separately. Delivery is possible for orders through the online store wherever transport companies deliver products. Shipments are always delivered as a package. The delivery times presented in connection with the delivery options are usually non-binding estimates.

If pickup from our office has been chosen as the delivery method, the order can be picked up from Finsket's factory store in Kokkola during the store's normal opening hours. The address is Terminaalikatu 7, 67700 Kokkola, FINLAND. When the order is available for pickup, you will receive a notification by email.

If the package is returned undelivered or due to incorrect information provided by the customer, we charge €9 for the return and resending. We charge €7 return costs for not picking up the package.

As a general rule, the first order of a wholesale or retail customer is delivered only after we have received the payment. The delivery methods available to wholesale or retail customers may partly differ from the delivery methods available to consumers. The available delivery methods are generally visible when the wholesale or retail customer has logged into their user account and starts placing an order.



6. Inspecting the delivered products and product defects


Finsket delivers the ordered products in the ordered quantities. For consumers, liability for defects in Finsket's products is determined in accordance with the Consumer Protection Act.

A consumer-customer is obliged to inspect the products immediately after delivery and to report any errors to our customer service by using the above-mentioned contact information by phone or email. If the product or package is damaged during delivery, the customer must also immediately complain to the service provider responsible for the delivery. In connection with the defect notification, the customer must also present the purchase receipt. Notification of incorrect delivery or defective product must be made within 14 days of receiving the product. If the product is faulty, it can be repaired or replaced to a new one.

The wholesale or retail customer is also obliged to inspect the delivered products immediately after delivery and to notify Finsket in writing (e.g. by email) and without delay of any possible defects. If the product is found to have a manufacturing defect, the primary remedy available to the wholesale or retail customer is repair or new delivery.


7. Right of cancellation, return and exchange (for consumer customers)

 
A consumer has the right to cancel a distance sales order (such as an order made and placed in the online store, by email or by phone) by notifying the cancellation within 14 days of receiving the product at the latest. The right of cancellation does not apply to cut-to-measure fabrics or other products modified according to customer-specific requirements. If you have the right to cancel the order and you decide to cancel the order, the product must be returned within 14 days of making the cancellation notice.

 If you are a consumer and you have the right to cancel a product order and you want to do so, we ask you to notify us in writing of exercising your right of cancellation by sending an email to asiakaspalvelu(a)paapiidesign.com, including the following information: (1) your name, (2) your address, (3) your phone number and email address, (4) a copy of the order confirmation or order number, (5) the date of order and receipt, (6) information about the products you wish to cancel, and (7) if necessary, information for a refund. We will notify you by email without delay of the receipt of the cancellation notice. Return the products by filling out the return form that came with the products and deliver the returned products to the address mentioned in the form.

 The consumer pays the shipping costs for returning the products.

 If the consumer had already paid for the products to be returned, the payment will be returned to the customer within a reasonable time after receiving the returned products. The payment will be returned using the same payment method with which the order was placed. Cancellation of the order is possible and the customer has the right to a refund only when the product is returned new, unused and undamaged, with the original tags in place or in its original, unopened packaging, if the product has its own packaging.

 Failure to pick up the goods from the post office or other pick-up location without a separate notice of cancellation is not considered a cancellation of the order.

The ordered product can be changed for another one under the same conditions and procedures as the order can be cancelled. However, in change situations, the customer can use Posti's or Matkahuolto's contract number free of charge.

 The wholesale or retail customer does not have the right to cancel or change the placed order without the consent of Finsket.

9. Force majeure

 
Finsket is not responsible for any breach, delay or deficiency that has been caused by reasons beyond its control (force majeure events).
 

10. Applicable law and dispute resolution

 
  
These terms and conditions, the agreement between Finsket and the customer and all disputes between Finsket and the customer are governed by Finnish law, excluding its conflict of law rules.

All disputes between Finsket and the customer are primarily resolved through negotiations. If this is not successful within a reasonable time, the disputes will be resolved in the first instance in any competent district court in Finland. In addition, the consumer has the right to file a lawsuit in the district court of the locality in Finland in which the consumer has a domicile or permanent residence. The consumer customer also has the right to request a settlement recommendation from the Consumer Disputes Board. Before taking the matter to the Consumer Disputes Board for consideration, you should contact consumer advice, because otherwise the Consumer Disputes Board may leave the matter unprocessed (more information: kuluttajariita.fi and kuluttajaneuvonta.fi). If the consumer wishes, the consumer can also initiate the processing of the matter through the European online dispute resolution forum ODR (more information:https://ec.europa.eu/consumers/odr).
 

11. Additional terms and conditions applicable to business customers

 
Delivery term, transfer of risk of loss and retention of ownership. Unless otherwise agreed, risk of loss for the delivered products is transferred to the customer when the product has been handed over to the transport company or courier. For deliveries outside of Finland, the customer is responsible for the products' customs clearance, customs duties and taxes and other similar payments in the customer's home country or another country where the Product is delivered outside the European Union. Ownership of the delivered products remains with Finsket until Finsket has received full payment.

Limitation of liability. Finsket shall not be liable to the customer for any indirect or consequential damages, including loss of income or turnover, business losses, goodwill impairment, lost profits and third party claims or damages. Finsket's liability towards the customer (including possible price reductions and refunds) shall under no circumstances exceed the VAT-free amount of the order to which the liability or breach of contract is most closely related.

Wholesale or retail customer user account. If Finsket considers it justified, it can remove the wholesale or retail customer's user account from the online store. Such reasons are, for example, misconduct by a wholesale or retail customer, neglect of payment obligations, or actions contrary to Finsket's wholesale and retail terms and conditions.

Additional conditions for wholesale or retailer customers. By purchasing products from Finsket, the wholesale or retailer customer commits to complying with these terms and conditions, and Finsket's additional terms and conditions for wholesale or retailer customers that are valid at any given time, which are available by logging into Finsket's online store with the wholesale or retailer customer's user account.
